Landslide at Tanjung Bungah affordable housing construction site
Rescuers have unearthed three bodies at the construction site hit by a massive landslide in Tanjung Bungah here today.
Penang Fire and Rescue Department director Saadon Mokhtar said the search was ongoing for 11 more people believed to be still buried underneath the muddy soil.
“We found the first two bodies at 9.15am and 10.45am while we found the third one at about 1pm,” he told reporters at the site.
The three dead were among 14 construction workers including a local who were buried by the landslide.
He cautioned that efforts to locate the remaining victims would be slow and arduous as the slope is unsteady while soil conditions were muddy.
“We believe some of the victims are buried deep underneath the muddy soil, as deep as 35m below the surface,” he said.
“We are also getting the canine unit to assist in the search and rescue operations,” he added.
The workers had been working on the underground portion of the site when the landslide occurred, he said.
Saadon added that his department has detected other unsafe areas in the vicinity and ordered for all construction work to be stopped immediately.
In the 8.50am incident, about 20 construction workers were working at the site of the affordable housing project when the soil on the adjacent hill slope next suddenly collapsed.
A total 14 workers failed to escape and were buried by the mud and soil.
Search and rescue operations are still underway and the local authorities have also issued a stop-work order against the project.
The construction is for the Granito@Permai affordable housing project at Jalan Lembah Permai.
The development consists of a 49-storey building with two towers and 12 levels of car parks. It has 980 units for sale at below RM400,000 and was listed as an affordable housing project.

If not mistaken, this project is by BSG property and this company has in the past shown no hesitation in indulging in unethical (if not illegal) practices.

Who approve this project without check land ok or not. Even I apply sp chilliah in near komtar the land not good. I ask pejabat tanah komtar I already reject this projects. High floor 38 floor. Do many project without check land ok or not …

The EIA report is not neccessary for the APDL. Only the SiFUS needs to be complied. The Sifus is basically Sijil Formula Unit Syer to set out the parcels for the respective units for sale to facilitate the issuance of strata title on handing over VP.
The developer got the green light from the state govt to start building. The state govt clearly gave the Commencement of Work order in the absence of an EIA report which is wrong
Not all development project needs to have EIA. If all 22-23depts comments they follow and adjusted according to comments, the plan will approve by committee during OSC meeting by council. This is landslide issue and i felt the C&S engineer involved should explain on it.

So has the location of the said building been “adjusted accordingly” away from the blast site since from what I read in the news, one of the major concerns by DOE was the proximity to the blast site + danger of hillslope?

MPPP said the proximity was sufficient, and the hillslope gradient was less than 25 degree. So approve and proceed.

The DOE (federal govt) clearly rejected the project due to the proximity with the quarry site. Therefore the OSC should have insisted on an EIA which they did not.

Hi Johnson, as for Federal they rejected and felt that the proximity is not enough. However as for MBPP, their side said sufficient. Thats is why got the approval. Anyway, the approval is based on state and not federal.
I felt the project is adjacent to hillslope, and not standing at hill slope. A proper retaining wall or soil nailing maybe should be build at the slope first before work at site started. However, we are not their consultant. We all unsure whats is going on internally.
Just 1 question, can I cancel my purchase? I have signed all the documents & paid for the deposit. However tis happening made me feel uncomfortable to stay there in future.

Your request for cancellation sounds reasonable. If BSG refuse your request, get a lawyer to sue, in since I am very sure there will be many others thinking about cancelling, get together to come up with a consorted strategy.
Certainly you can cancel your purchase, but all the deposit you paid will be forfeited. Unless you can show a very solid proof that the building is not suitable for stay. Engaging lawyer to sue the developer to get back your deposit will go through a long battle, you have to mentally and financially prepare for that.

You can go to your bank to have your loan canceled citing “face an unstable income outcome”! The Bank would then probably review and “缩沙”! This is major “condition” the developers dread to face but they can only cancel the deal and you Get back your deposit!

Out of good will and to protect its reputation the developer should give a full refund together with any interest paid to the bank. Legally they are not bound to give any refund.

My previous boss did it sometime in 2014 ! It was just after he paid the 10% and “the bank rejected his loan for certain reasons”. But the bank needed a “confirmation letter” from my boss too just in case. The SPA of the house stipulated clearly :- financing is a major condition in the whole agreement, i.e. a breach of condition in any contract it is then void or invalid.

I feel really sorry for those “walk-in buyers” who buy from BSG. If you’re a BSG crony, you get to buy nice units at 25% lower price, but if you’re a “walk-in buyer”, you only get to choose the left over at 25% higher price. Even when it comes to cancellation & refund due to landslide, cronies get easy cancellation and full refund, while walk-in buyers have to call here call there, be given the runaround by the small potato staff, and still can’t get any refund. Do yourself a favor lah, dont ever buy BSG anymore.
tip: you need to know the right guy and then you will get your refund… call in and walk-in to find out, you will waste your time and get noting and frustrated..

This is my first home I got the letter from government for the affordable house which is not really affordable, yet I thought I am lucky enough and thank God , and now I really wish I could get to cancel the purchase and get full refund. Please guide me to the right way and right person. Millions of thanks in aadvance !!
Hi fellow purchasers, what are we going to do? We are not keen in this project anymore after the tragic landslide. Please advise what we as a group can do to get our hard earned money back. Anyone can help???
