    i went to have a look recently, LOVE the environment, LOVE the plan, LOVE the 2nd phase terrace, VERY nice design BUT

    phase 3 only 22X40 build and the porch is 20ft!! price so much higher! I am thinking, if i buy…..unless that the developer manage the environment …. that is good…better still if guarded. I think this place is not guarded…right?

    This is not “officially” a guarded community. But i think they will hire a guard and setup a tent beside the roadside :).. i can see someone there, but not sure about future.

    i am not sure how well will they manage the parks. I was told that they will surrender it to MPSP….MPSP! I am concern if they do not have it guarded, soon people from the surrounding kampung will come in and out and easily privacy concept will not work

    As long as it is not a strata housing, they will have to surrender the taman to MPSP. Even if you manage to hire a guard for that area, the park is still going to be managed by MPSP.

    I bought the phase 2. Totally agreed with Apple’s concern. Most probaly the residents need to hire thier own guard and gardener to keep the place. The place should be kept well by DNP as long as they have phase 4 (next to phase 1 terrace). Hopefully they will have phase 5 or 6 as well if they manage to secure more land beside phase 2.

    Current guard was hired by DNP as there is construction of phase 2 and 3.

    i doubt that there will be phase 4 or 5 or 6 for BM utama as they have started promoting jesselton as the next project. Funny things is that even that the houses at BM Utama is so sky high, the houses surrounding does not even increase significantly. As for the parks, if there is no guarded or gated or controlled, sure alot of outsider will use. I understand what Apple mean….

    From google maps satellite view, Sammy is right. I don’t think there will be more phases. I think other surrounding land owned by someone else.

    Same as BM PERMAI, I did ask sale office before, why they develop so less houses compare to BM Utama since the surrounding of BM PERMAI still got many empty land… Their answer to me is the empty land is owned by some Malays and they don’t have the interest to sell it for housing development. I think most of the land there(BM UTAMA & BM PERMAI) are own by Malays since the area there is “Malay Kampung”. Of course they did tell me they still negotiating with the owner.

    i go to the office last weekend. I like the place alot as it is very natural but i work on the island and would want to sell my appartment for a house here. I heard the sales say the there will be fly over from the highway. I survey and do not think that will solve the jam as the roads on certain area only 2 lane. I drive from island 2 days ago after work and it took me 1 hours jam to utama!

    If you are looking for Semi-D, you can consider Taman Gemilang Permai. less traffic issue.

  11. mason
    April 8th, 2011 at 09:37 | #11

    @Kao
    Ya, flyover must be consider by authorities in front of Krico, if not for those who live at Utama & work at Penang, it will be jam for go and back from work.
    In this case, BM PERMAI will be more better as it far more closer to the main road compare to BM UTAMA.

    Or you change your job to Kulim Hi-tech then BM utama will be a good location for you.

    I think Taman Gemilang Permai developed by Airmas right? I also notice the price that they are selling! Very expensive. I notice the malay kampung and I saw some development behind the kubur. Are they building an extra road there?

    Kao, it takes 45 mins to 1 hr to drive from FTZ to BM. There is another way to go to BM Utama if the traffic is really bad. Traffic should improve when there is second link and all the flyover for double track railway is being built.

    I have ex colleagues selling thier apartment in Penang and bought semi D in BM Utama.

    Car porch is only 20ft is too small. There is not extra place to sun our clothing. The park is nice but after they surrender to MPSP then will be not well maintain and this is open to public, maybe for the 1st few year we are able to enjoy at there but who gonna bear those broken stuff?

  19. PPT EDITOR

    May 5th, 2011 at 01:08 | #20

    @Jason
    There are pros and cons.

    Strata titled – Everyone is the owner of the gated community. The owner can be part of the team to decide how their housing area is managed. Usually this kind of gated community are very well maintained at all time (presuming it is a medium or luxury residential). Maintenance fees are usually higher. You can take action if anyone don’t want to pay the maintenance :). JMB is required by law, so it will be long term.

    Individual titled – You still can have a guarded community, but JMB is not required by law. So you will have less control at some point. Everyone can renovate their house any way they want. Maintenance fees are usually minimum (for guard and gardening). If anyone don’t pay maintenance, there is no law to govern.

    Nowadays some people don’t really care so much. Some individual titled can also be well maintained (eg. Setia Pearl Island). But one thing for sure, usually you will only get a swimming pool in your gated community if it is strata titled.

    So the choice is still yours :).. I personally don’t really have any preference on the title. But in order to make sure my housing area is well maintained at all time, i would prefer strata titled property if given a choice.

    For BM Utama, i don’t think they have the same level of security as Setia Pearl Island. They can guard the area for now, but when other developers start to develop the adjacent piece of land, then the entrance to BM Utama is going to be a public access road. Because the road will eventually connect to other housing areas, it will be prohibited by law to block the road from public access.

    Hope this will help :)

    I am currently looking at a semi-D and i am a residency from Desa Palma. For my information, the main road outside the BM Utama is a flooding area. Everytime after the heavily room, the traffic problem at there are kinda serious and i have to use another main road which is Jalan Keensway only i can reach Bukit Minyak. BM Utama concept is not bad, but the flooding problem is one of the consideration. I have look thru the GTM company project thru the website have been share, is in front of the school the location will be locate at the hillside?

    BM Utama Phase 3, 3-storey Terrace built-up area really too small (22′ x 40′) with RM468k. I’ll look small & narrow for 3-storey. Compared to Phase 2 2-storey Terrace, it’s bigger than Phase 3 3-storey Terrace.
    Does anyone knows that Phase 3 terrace comes with Security Alarm System ??

    I just feel that the price of 408k is too risky as for current economy situation.
    Far away from the actual value.

    the 2 storey and 3 storey house’s build up is only 22×40 and the master bed room is too small…this is worst !!!….but the quality of the materials that given by DNP looks far better than what BM PERMAI’s developer gave eg staircase’s its holder, tiles in bath rooms and bed rooms….. but the build up size is too small especially the length of the house..it is only 40ft …..too bad !!!

    September 23rd, 2011 at 14:13 | #46

    FYI, the so called “guarded” is a joke, I went to BM Utama to check on their night time security, but shockingly, the security is so kind to let my car pass through without even asking me which house I’m visiting!

    Furthermore, I realized that the road lamp is not enough, which escalate my worries on the security to the next level.

    I plan to buy the 498K 3 storey terrace previously… but I think I’ll pass…
    build up area too small, furthermore, I heard the owner in BMU is going to protest against DNP plan to build new lots at the recreation park area of Phase 3 which they earlier promised.

    April 23rd, 2012 at 17:40 | #56

    @SY

    The funtion of retention pond is to keep the overflow water from drainange when heavy rain time. It might become mosquito’s home if it is not well maintain in future especially when the retention pool is occupied by the water plants or bushes without maintained. From overall fengsui talk, if the back of your house got big pool/retention pools then it is considered not a good house! But sometime fengshui will depend on a person’s “chi” too 😉

    Bigger build up size compare to Phase 3 and Phase 2. You pay more for greenery environment. Good service from the developer. Good location as it’s not far from autocity or Juru highway to Seberang Jaya, BM town or Impian Indah area. Other projects by other developer at Alma area also around that price…there are always pros and cons. Permatang Santuary is cheaper but it’s a bit far if you need to go to Penang or Seberang Jaya area. e@SunnyWong

    The new taman, Taman KOTA permai II house already ready. I saw some house people not moving in yet, it could be some people is investing it or plan to resell later. It is about 1 minute drive to BM utama, the best part is it is 22X 1XX sf long for one of the phase project. You can park 4 car in front of the house also no issue.

    Recently i heard there is a house just sold out with about 460k. If you have time, you can go there to take a look.

    DNP did not promise. We were told that it’s guarded and not gated. It is up to Residence to have the guard post. Recently there is other developer that build new housing project and would like to share the same service road. I wonder why they can’t open their own road. There is one man called Michael Tan complain about the guard post and talk bad in our FB page. I think he is not the residence as we invite him out to discuss but never show face. Most probably from other property developer that want to tear down our guard house and use the same service road.

    BMU is definitely not a gated development. Just look at your land title, it’s individual not strata. But I personally feel we should have guard post at the main entrance IF there is no more linkage to the neighboring “taman”

  137. lluna
    August 29th, 2014 at 17:17 | #138

    But there is one problem here if to maintain the existing guard post because the future owner of Sentinelle Ville (new semi-d) will not agree to it. Sentinelle Ville is a gated & guarded development, so no point having the second guard post for them…need to figure this out.

    Basically, the whole JH project is guarded community which we can expect to see the guard house will be built up officially in every phase without any concern like BMU facing now. However the guard service is subject to the residents in each phase.

    For JH2, there will only have one entrance (surrounding by Saujana Indah, a big drainage and the man-made landscape) and this will make thing easier to manage.

    hi there, wish to check anybody interested to file case against the developer for misrepresentation … we have all the supporting documents to prove DNP deliberately mislead the house buyers by promising landscape garden as inducement .

    For your info, DNP had paid compound to KPKT/ Jabatan Perumahan for advertisement offence.
    We have not lose any case … only 2 buyers pursuing matter to Lembaga Rayuan for failed to provide notice of development..

    We will file the case in civil court next month for misrep..and invite who ever interested to flight for justice and may benefit for damages.. If you failed to file case by 6 years of date of SNP,..you may lose your legal right…

    We do have strong case… be united and set precedence for future housing ethic ..

    @KittyCat

    You are wrong. KPKT already included property house brochures as part of the legal / contract documents. That is why, for sales and public circulation purpose, it must contain info like developer license, advertising permit, MPSP approval number, validity date, etc, etc. Property advertisement brochures already not the same like cars, furnitures, computers, handphones, etc advertisement brochures.

    ABDUL RAZAK DATUK ABU SAMAH V. SHAH ALAM PROPERTIES SDN BHD & ANOTHER APPEAL
    COURT OF APPEAL, KUALA LUMPUR
    GOPAL SRI RAM JCA SITI NORMA YAAKOB JCA HAIDAR MOHD NOOR JCA
    [CIVIL APPEALS NOS: W-03-41-98 & W-03-43-98]
    5 APRIL 1999

    CONTRACT: Damages – Assessment – Contract set aside – Measure of damages – Whether on footing of breach of contract – Whether on basis of rescission of contract – Whether s. 74 of Contracts Act 1950 applicable – Expenditure reasonably incurred in consequence of fraudulent misrepresentation
    CONTRACT: Misrepresentation – Fraudulent misrepresentation – Voidability – Rescission – Damages – Assessment – Placing innocent party in the position as though there was no reliance on fraudulent misrepresentation
    CONTRACT: Breach – Condition – Repudiation – Obligations de futuro – Damages – Whether innocent party can have contract set aside – Distinction between rescission ab initio and repudiation – Whether repudiatory breach brings about rescission ab initio

    The plaintiff purchaser claimed that he had entered into a sale and purchase agreement with the defendant vendor in respect of an apartment building based on the defendant’s fraudulent misrepresentation. The High Court dismissed the claim but on appeal the Federal Court set aside the agreement and ordered the defendant to, inter alia, refund the purchase price with interest thereon and pay damages to be assessed by the High Court. The senior assistant registrar assessed damages at: (i) RM46,000 for loss of value of appreciation of the property; (ii) RM5,999 for loss of value of appreciation of the club membership of the property; (iii) RM142,240.22 being interest paid by the plaintiff to the bank (‘the said interest’); (iv) RM72,790.10 being interest at 8% pa on the said interest; and (v) RM5,500 for a valuation report on the property. The plaintiff’s claim for loss of rent which he alleged he would have received had the transaction been completed was disallowed. Both parties appealed against the SAR’s decision but the judge in chambers dismissed them. Before the Court of Appeal herein, the issue which arose for decision was: what measure of damages was the plaintiff entitled to recover consequent upon obtaining a decree of rescission of the agreement he had with the defendant?

    Held: Per Gopal Sri Ram JCA

    [1] What the Federal Court ordered was a rescission of the contract on the basis of fraudulent misrepresentation. Therefore, the assessment of damages should not be on the basis of a breach of contract, which would be to put the plaintiff in the position as though the contract had been performed, but on the basis that the contract had been rescinded, which would place the plaintiff in the position he would have been had he not been induced by the fraudulent misrepresentation. Hence, the plaintiff was only entitled to recover expenditure reasonably incurred in consequence of the fraudulent misrepresentation, whether before or after the rescission.

    [2] Consequently, items (i) and (ii) and the claim for loss of rent were not recoverable as they amounted to damages for breach of contract. Items (iii) and (iv) were recoverable as they constituted expenditure reasonably incurred in consequence of the fraudulent misrepresentation. Item (v) was an expense related to the proof of damages in contract; it was not a reasonable expense and thus irrecoverable.

    [Plaintiff’s appeal dismissed; defendant’s appeal allowed in part.]
